3.2 When you have completed an order on the App you'll automatically receive an order acknowledgement. The Order Acknowledgement and order number are not an order confirmation or order acceptance from us. Acceptance of your order and the completion of the contract between you and us will unless we have notified you that we do not accept your order or it has been cancelled take place when our personal shopper has completed the shop at Sainsbury's and you have paid for it. You accept that the contract for the goods is between you and Sainsbury's and not Chop Chop. The contract for the collection and delivery of the goods is between you and Chop Chop.
4.1 Downloading the Chop Chop App is free.
4.2 There is no minimum spend but we will limit the number of items that you may buy at 20 items or such other number of items as Chop Chop will from time to time advertise, subject to Sainsbury's bulk purchase policies. Purchases at concessions, the kiosk, café, prescription medicines and petrol stations are not available.
4.3 The Chop Chop App allows you to purchase products from Sainsbury's for delivery by Chop Chop within an hour. The App will show only products that are available and the product range may vary from that found in-store. The prices you will be charged for the goods will be the prices shown on our App at the time you order the goods plus the Chop Chop delivery charge. These prices may differ from prices charged instore. If you order 'catch weight' items like meat, vegetables and fruit, the weight of some goods may vary marginally from that ordered and the price will change to reflect actual weight. You accept that prices of goods may, therefore, increase or decrease between order and delivery.
4.4 The pricing shown on the App may, despite the best efforts of Chop Chop and Sainsbury's be incorrectly priced. If the correct price is higher than the price stated on our App, Sainsbury's are under no obligation to supply the goods to you at that price and our personal shopper may inform you by Instant Message during the shop to give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order for that item as cancelled. You will be able to set a basket preference choosing to accept substitutions or not.
4.5 We offer a substitute price promise. We'll offer substitutes when grocery goods you order are unavailable unless you've asked us not to. If you accept a grocery substitute costing more than the item you ordered we'll charge you only for the item you ordered. Offer includes grocery items only and excludes baby milk and tobacco products. If you accept substitutes costing the same or less than the item you've ordered we'll charge you for the item we deliver. Chop Chop reserves the right to amend or withdraw this offer at any time and without notice.
4.6 The Chop Chop App is owned by Sainsbury's and although Sainsbury's takes all reasonable care to ensure that all descriptions, appearance and details of goods appearing on their App are correct at the time when the information was inputted onto their system, it may not reflect the exact position at the moment you place an order, and goods may vary slightly from the actual colour or appearance on delivery.
4.7 When ordering using the App, you must pay for the goods and the Chop Chop delivery charge when you checkout. Full details of delivery options including expected delivery times and pricing will be displayed in your basket before you begin the checkout process.
4.8 The delivery charge that will apply to your order will be the rate applicable on the date and time of purchase. Our delivery rates are also displayed in the 'checkout' section of the App and may change from time to time.
4.9 All prices are shown in £s sterling and include VAT where applicable.
4.10 Orders including alcohol may only be made during normal licensing hours.
4.11 Food goods will be picked and delivered at an appropriate temperature. We deliver using paper bags or using our own delivery bags which will be taken away by a courier of the third party delivery partner after use.
5.1 All goods shown on the App are subject to availability. If for any reason beyond our reasonable control we are unable to purchase a particular item we will not be liable to you except to ensure that you are not charged for that item. In the event that we are unable to pick the goods you have ordered, our personal shoppers will advise you by a phone call or text. If you do not respond they will not provide a substitute.
5.2 Goods are supplied only for a customer's own use as a consumer. We reserve the right to refuse orders that we consider are for commercial or non-domestic purposes or subject to onward delivery by a third party.
5.3 Sainsbury's may apply order limits to alcohol and other products and our personal shoppers will respect these limits. Chop Chop may apply other maximum order limits where appropriate and will limit your order size to 20 items or such other number of items as Chop Chop may from time to time advertise. 5.4 Quantities of goods supplied per order may be limited if the order creates a potential health and safety issue for our personal shoppers . We will fulfil bulky orders subject to the availability but in some circumstances, large orders may incur more than one delivery charge. We will let you know if this applies to your order.
6.1 Customers using the Chop Chop App accept the need to register their payment details including credit or debit card details prior to ordering. These details are held in an encrypted form on the Braintree server (a secure server encrypted to PCI DSS standards) and will be used for payment of goods and services received by you when using our Chop Chop App. Online payments for the Chop Chop service are processed by Braintree. Your personal data will be used by them for the purposes of processing your order only.
6.2 Payment must be made with a valid credit or debit card. The address at which the card is registered must be the same as your billing address.
6.3 To ensure that your credit or debit card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency.'
6.4 If we are unable to process your credit card payment, our Customer Care Team will contact you to request new details.
6.5 Where you add an age restricted item to your basket we may verify your age details against the Experian database. By accepting these terms and conditions or by using the Chop Chop service you consent to such checks being made. Experian will check your details against their database and provide us with a green or red response. Where we receive a red response we will remove any age restricted items from your basket. Experian will not provide us with any reasons for their decision.

7.2 Should adverse weather conditions or any other event outside our reasonable control result in a later or cancelled delivery, we will contact you as soon as possible to re-schedule your delivery or to cancel it. All alternative delivery times are subject to availability. Should you incur any loss as a direct result of such a delay our liability to you shall be limited to the value of the delivery charge only.
8.1 Chop Chop is separate from any delivery service offered by Sainsbury's Supermarkets Ltd and a delivery charge will always be charged. Chop Chop deliveries do not qualify for any free or reduced rate delivery charges offered by Sainsbury's and Delivery Passes are not accepted. Chop Chop reserves the right to amend delivery charges at any time without notice.
